Distance Sales Agreement

English courtesy translation. The Turkish text below it is the legally binding one, and the one your registration is concluded under.

The subject of this agreement is to determine the rights and obligations of the parties, in accordance with Law No. 6502 on Consumer Protection, in relation to the sale and delivery of the service whose qualities and sale price are stated below and which the CONSUMER has ordered electronically through the heliz.life website.

Parties

Information on the Product, Payment and Delivery Covered by the Agreement

Cancellation and Refund Conditions

Participants have the right to cancel their registration up to 30 days before the race date at the latest. In that case 80% of the registration fee is refunded, after deduction of transaction costs.

No refund is made for cancellations within 30 days of the race date. If the organisation considers it appropriate, a participant may be permitted to transfer their place to another person.

If the event is cancelled or postponed for reasons of force majeure, registrations are carried over to the new date. If a participant requests cancellation within 7 days of the postponement decision, 80% of the registration fee is refunded. In the event of full cancellation, the refund is made without any deduction.

Refund requests must be sent in writing to the official e-mail address of the organisation. Refunds are made by the same payment method within 14 business days of the request at the latest.

- Aquathlon:

For aquathlon races, cancellation is possible within 7 days of registration. In that case 80% of the registration fee is refunded, after deduction of transaction costs.

Rights and Responsibilities

Heliz Life may cancel a user's membership in whole or in part where necessary, and is obliged to inform the user of the reason.

If services are partially suspended or cancelled, care is taken to ensure that the user suffers no loss; the user is informed.

Heliz Life may make updates to its systems where it considers this necessary; the user accepts that they will act in accordance with those updates.

The products and services sold are provided by the organisers. Heliz Life cannot be held responsible for problems that may arise after the sale.

Heliz Life may change the content of the agreement because of legal obligations; changes are announced by e-mail, by notification in the application or through the website.

Rights and Obligations of the User

The user is responsible for the accuracy of the information given during membership and event registration. Any change in that information must be notified to the organisation.

A membership account may be used only by the user and may not be transferred to anyone else. The user is responsible for any loss arising from use of the account by others.

Heliz Life may request additional documents where necessary in order to verify user information. If the request is not met, it may cancel the membership unilaterally.

Use of the System and Registration Payment

You may use the system by becoming a member of Heliz Life and logging in. Payments are made by credit card, debit card or equivalent cards, or — where offered on the payment page — by bank transfer (havale, EFT or FAST).

If bank transfer is selected, a payment code specific to the order is issued. That code must be written in the description field of the transfer and the amount must be sent in full; otherwise the payment cannot be matched to the order automatically. If the payment does not reach the SELLER's account by the payment deadline notified with the order, the order lapses by itself and no registration is created. Refunds of payments made by bank transfer are made to the IBAN notified by the BUYER.

Cancellation of Membership and Termination of the Agreement

If the organisation acts in breach of the agreement, Heliz Life may terminate the user's membership unilaterally or amend the agreement in its entirety.

Term of the Agreement

The agreement enters into force the moment the membership account is created and continues until it is terminated by the user or by Kaş Half Marathon.

Force Majeure

If the event is cancelled or postponed because of force majeure such as natural disaster, a state of emergency or acts of terrorism, Heliz Life is not obliged to give notice; that responsibility lies with the organiser.

Other Provisions

The invalidity or amendment of any provision of this agreement does not affect the validity of the remaining provisions. Heliz Life is entitled not to exercise its rights, and doing so does not amount to a waiver for the future.

In the event of a dispute, the courts of the province of Antalya have jurisdiction.
